Chapter 7
If you qualify for Chapter 7 (also called "liquidation") then you will not have to repay your debts. Instead, all eligible debts are discharged and you get a "fresh start" once the court approves your bankruptcy petition.
Under the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, you are eligible for Chapter 7 if your average gross income for the six-month period preceding the bankruptcy filing is equal or less than the state median income for the same size household. The current median income for a single filer in the District of Columbia is $42,340; for Virginia, the current median income is $49,689; and in Maryland, the current median income for a single filer is $55,543.
